Bryan F. Russ III ("Trey"), joined the law firm in 2006. Trey Russ graduated Magna Cum Laude from Baylor University in 2002 with a 4.0 GPA in both his major [political science] and his minor [criminal justice]. While at Baylor, Trey was inducted into Phi Beta Kappa. He attended Texas Tech School of Law on a Regent's Full Scholarship and graduated Magna Cum Laude in 2006. While in law school, Trey won the Mock Trial Competition and the Negotiation Competition, served as Chairman of the Board of Barristers, received the Board of Barristers Member of the Year Award, and was inducted into Phi Delta Phi.
Trey has been recognized as a 2013 - 2020 "Texas Rising Star" by Super Lawyers.
Trey is admitted to practice in all courts throughout the State of Texas, as well as in the United States Supreme Court.

Representative Civil Litigation / Personal Injury Cases
- Represented the son and daughter of a man who was killed in a vehicular tragedy on a two lane highway when an 18 wheeler attempted to pass the man while he was making a left hand turn onto a county road (confidential settlement reached)
- Represented a driver who was hit by an 18 wheeler on a rural two lane highway which resulted in client suffering injuries to his face requiring surgical repair (confidential settlement reached)
- Represented a large ranch in Robertson County (both before the District Court and the 10th Court of Appeals on mandamus) in a breach of contract lawsuit involving an underlying contract to purchase 10,000+ mineral acres (case subsequently settled)
- Assisted in the representation of the son of a man who was struck and killed by a truck while crossing the highway at a crosswalk in a motorized scooter (confidential settlement reached)
- Represented a woman who was rear ended by an 18 wheeler while she was waiting to turn left into a rural subdivision resulting in her suffering serious bodily injuries and property damage (confidential settlement reached)
- Represented a driver waiting to make a left hand turn off a two lane highway onto a county road who was rear ended by an 18 wheeler that failed to stop resulting in the client’s truck and trailer being totaled, as well as the death of his son’s show steer (confidential settlement reached)
- Represented children whose mother had under unusual and unexpected circumstances allegedly signed an earnest money contract several weeks before she died essentially selling her home and all her property for mere pennies on the dollar. Trey filed suit against the purported buyers alleging that the contract violated the statute of frauds for failing to set forth a proper legal description of the property to be conveyed. After a motion for summary judgment was granted in favor of client finding that the legal description was void for failure to satisfy the statute of frauds, the case settled, the contract was rendered void and children (clients) were able to inherit/keep all of the family land and home.
- Represented a man in a lawsuit who was sued by his neighbor for trespass, nuisance, negligence, the imposition of a constructive trust and for rescission of a previous property transaction. (District Judge granted summary judgment in favor of Defendant on all causes of action brought by Plaintiff) (Case Affirmed [upheld] on appeal by the 10th Court of Appeals)
- Represented a woman who was waiting to make a left hand turn off a state highway when she was rear ended by an 18 wheeler resulting in her suffering bodily injuries, as well as property damage (confidential settlement reached)
- Represented a woman in a lawsuit over a dispute as to the rightful owner of insurance proceeds related to the death of her father (proceeds awarded to client)
- Represented a husband and wife who were injured in a vehicle accident when a man failed to properly yield the right of way and collided with their vehicle (confidential settlement reached)
- Represented a man in an interpleader suit involving multiple claims as to monies held by a financial institution for a deceased woman (settlement reached after client filed summary judgment)
- Represented a general contractor sued in Austin County, Texas for alleged breach of contract, DTPA claims and negligence as it pertained to a roofing job completed by client (case non-suited with prejudice by Plaintiff's counsel 3 hours prior to Plaintiff's deposition)
- Represented a woman involved in a vehicle accident who suffered a damaged breast implant as the result of a man failing to properly yield the right of way (confidential settlement reached)
- Represented the guardian of an elderly woman’s estate in an intervention into a divorce case involving the elderly woman’s son and daughter-in-law bringing claims on behalf of the guardian for breach of fiduciary duty and conversion (successfully recovered several tracts of real property for woman's estate)
- Represented three teenage passengers injured in an automobile accident as the result of the driver falling asleep at the wheel and hitting a tree (confidential settlement reached)
- Represented a property owner in a suit brought by an adjoining landowner seeking an easement across client’s property
- Assisted in the representation of an insurance company against the certification of a class action lawsuit
- Represented a woman who was sued for conversion by a prior employer
- Represented a car dealership sued for various causes of action, including fraud, breach of warranty, etc.
- Represented a father and son sued by the father’s deceased brother’s wife for fraud, undue influence, forgery, conversion and breach of fiduciary duty (Plaintiff dismissed suit after client filed No Evidence Motion for Summary Judgment)
- Represented a convenient store owner sued by a customer for allegedly selling bad gasoline (settlement reached)
- Represented a land owner sued by his neighbor related to the location of the spillway of a dam built by client on client’s property (settlement reached)
- Represented a land owner successfully bring a suit for adverse possession against heirs of a prior record owner
- Represented a home owner sued in a premises liability case wherein the Plaintiff fell in client’s home (after the Plaintiff’s deposition was taken, Plaintiff dismissed his case)
- Represented a man in a claim against his insurance company after the company refused to provide coverage for an accident in which he was involved (coverage subsequently provided)
- Represented a man involved in a vehicle accident who suffered injuries as the result of a rear end collision (settlement reached)
- Represented a couple (grantors) sued by individuals they previously sold property to (grantees) wherein clients were sued for (1) alleged claims under the Texas Deceptive Trade Practices Act, (2) common law fraud, (3) statutory fraud and (4) fraud by nondisclosure. (District Judge granted Defendants' Traditional and No Evidence Motion for Summary judgment disposing of all claims made against clients)
Family Law Representative Cases
- Represented a husband sued for divorce in a case in Falls County, Texas with over $10,000,000.00 in marital assets.
- Represented a wife originally from California whose husband had filed for divorce in Leon County, Texas seeking jurisdiction in Texas; filed and successfully argued on behalf of wife a Motion for Court to Decline Jurisdiction pursuant to the Uniform Child Custody Jurisdiction Enforcement Act (UCCJEA) (after contested hearing the Court granted the Motion and transferred the case to a court in California)
- Represented client in a suit against her ex-husband for enforcement of an out-of-state Final Decree of Divorce and for breach of contract. Successfully recovered over $500,000.00 in monies due client pursuant to the Final Decree of Divorce.
- Represented and defended a husband against a protective order sought by his wife in a divorce case (Court denied request for protective order)
- Represented a husband in a divorce who after a trial was able to keep important aspects of his retirement plan in tact despite aggressive claims made by his wife
- Represented a married couple from Minnesota adopt a baby boy from Texas
- Represented a mother in a divorce who after a trial was awarded primary custody of her son, as well as the marital residence
- Represented a mother in a child custody case who after a trial was awarded sole custody of her children, as well as a protective order against her children’s father
- Represented a mother in a termination case seeking to terminate the parental rights of the child's father (Court terminated father’s rights)
- Represented a husband in a divorce case who after trial was able to keep his family farm in tact
- Represented a father in a child custody modification case who was awarded primary custody of his two daughters.
- Represented a father in a writ of attachment suit whose ex-wife would not relinquish custody of their children to him despite a court order. (Police executed the writ issued by the Court and removed the children from mother’s care and placed the children with their father pursuant to the Court order)
- Represented a father in a divorce case who after trial was awarded primary custody of his children
- Represented a father in a custody suit brought by the child’s grandmother seeking custody of the child after the death of the child’s mother (Court awarded sole custody to father)
- Represented a grandmother in a custody suit in which she obtained custody of her grandchildren
- Represented a father in a divorce case obtain sole custody of his child after his wife attempted to run him over with her vehicle
- Represented a wife in a divorce case with no knowledge of her marital assets or finances obtain a fair and just settlement of the marital estate
- Represented a father in a paternity suit who after trial obtained standard visitation with his son despite aggressive claims by the mother that he should only have limited supervised visitation
- Represented a mother in a divorce case who after trial was awarded sole custody of her daughter (father was given minimal periods of supervised contact with the child), as well as most of the community estate based upon husband's ongoing drug addiction
- Represented a mother (with a history of drug addiction) who had her child removed from her by CPS and placed with an adverse family member; after getting mother in extensive successful therapy filed for mother to regain primary custody and after contested trial mother was awarded sole custody of her daughter based upon grounds that mother was rehabilitated
- Represented many individuals in the preparation and negotiation of Premarital Property Agreements (Prenuptial Agreements).

- Represented a woman initially charged with capital murder as a result of her being present at the scene of a murder (State dismissed all charges against her)
